  7. bill raised on November 2016 and i made payment of the same bill on 10 June 17 and deduct tds 1%, am I liable to pay interest, or if i tell them to revised the bill date for eg. 31 May 17 still am i liable to pay Interest on TDS,Pls guide me.

    • Rohit Pithisaria

TDS is required to be deducted at the time of receiving bill or making payment, whichever is earlier. So in your case TDS is required to be deducted in November 2016 as the bill is received on that date. As the TDS is not deposited before the due date of deposit i.e. 7th December 2016 so you are required to pay interest for the same.

We cannot suggest you in the other matter which you have asked.

  8. Could you kindly explain the date from which the TDS Becomes due.

Suppose i have received a bill in the month of April but the Payment in regard to the bill is paid in June. In this case when does the TDS Becomes due??? From the date of payment or from the month in which the invoice is received ??

    • Rohit Pithisaria

TDS is due when the invoice is received (in the above mentioned example). TDS become due when the bill is due or when the payment is made, whichever is earlier. So if you made a advance payment then TDS become due.

  9. surinder singh

When TDS on Remuneration to Directors was less deposited for the whole year & during filing of return it comes into knowledge that more TDS shall be deducted so company deposited more TDS but it was not actually deducted from their Remuneration by the company at such case what one can do? Say Salary is 20000 TDS shall be 3000 But tds deducted & deposited 2000 ,what one can do with 1000 balance tds which has to deposited? can it be deposited without deduction ?

    • Rohit Pithisaria

You have to consider total amount (paid + deposited) as remuneration and then the TDS liability will be computed.

  11. TDS of Rs.4000/- was deducted for (TDS April-2017). I have to deposite on -09.05.17. How much Interest will be payable

  12. TDS of Rs.7375/- was deducted for Jan’17 to March’17. I have to deposit the same on 04.05.17. How much Interest will be payable

    • Prateek Agarwal

The month for which tds is deducted and the month in which tds is deducted in required for making interest calculation.

  13. Interest paid on 31 march 17 & TDS deducted on same day but not deposited on 30 Aril 17 then how to calculate interest

    • Prateek Agarwal

Interest is calculated @ 1.5% for month of March, April and May i.e 4.5%. Assuming that tds is deposited in month of May.

  14. Hi,

TDS of Jan_17 Deposited with govt on 7-MArch-2017 which was suppose to be deposited on 7-feb-2017 ,that means interest shall be calculate only for one month . But when I enter amount in above calculator it calculates interest for 3 months. i.e for TDS of 6500 Interest shall be 6500*1.5%*1=98 but above calculator shows 292 please clarify.

    • Prateek Agarwal

Calculation is somewhat tricky in respect to interest on late payment of TDS.
Calendar month is to be considered and even the month in which tds is deducted is to added. So 3 month’s interest is payable by you.

    • Syed Mustak Ahammed

Hello. Interest is to be calculated from the date of deduction if the same was not deposited with in due date i.e,7th February in your case.so interest is to be calculated from Jan 17

  15. Hi, suppose that we receive each month april to march rent bill of 20000 we dont deduct tds but in last month what we have to do?

    • Prateek Agarwal

You have to deduct TDS in last month itself for the whole year and pay interest on the amount not deducted for previous month.

  16. i want to clarify that if we deposited tds after delay of 43 days then interest will be charged for 43 days only or two months .

    • Prateek Agarwal

Calendar months is considered for interest calculation. So if the delay is from 7th Jan to 28th Feb (43 days) then the interest is payable for 2 months. Similarly if the delay is of 45 days and from 7th Jan to 2nd March then interest payable for 3 months.

  17. hi Prateek,

We purchased a property in August 2013. TDS amounting to 84,000 was deducted on 1st Aug 2013 however it was not paid since we did not have clarifications on how it has to be paid.

I want to pay the amount now. Please can you help me understand how much is the amount?

    • Prateek Agarwal

Interest is payable from August 2013 to Feb 2017 i.e 43 months @ 1% per month. Total amount payable by you is 84,000 and interest of rs. 36,120 (84,000 x 43%). Since the payment is delayed by more than 1 year, a penalty of rs. 10,000 can be levied by the Assessing officer.

  18. Suppose First Invoice is raised for 35000 and the second invoice raised for 15000 only..now in this case should I deduct TDS on both the payments or only on first 35000??

    • Prateek Agarwal

If the amount paid exceeds the threshold limits than TDS should be deducted on total amount. In your case the TDS should be deducted on total of Rs. 50,000.

    • Prateek Agarwal

      Three months (Jan to March)

      • suppose TDS was deducted on on Professional fees,Salary, rent rendered in Jan ,TDS on which payable by 07-Feb-2017 but paid on 07-Mar-2017. How many months shall be calculated for Interest Calculation

  20. Hi,

Is there additional late payment fees apart from the Interest? In my case i had paid VAT charges to the builder but have not deducted TDS for the same. TDS was supposed to be deducted on 7th Jan but I have paid full amount without to builder without deducting the same.

What do i need to do now? Thanks for the interest calculator.

    • Prateek Agarwal

No, there is not any late payment fees if the late period is less than one year. Last date of filing is 2nd of march in your case, try to recover the amount from builder.

  21. I want clarification tds … The TDS invoice raised in April 29th 2016 For rs, 300000 the amount was deducted but not remittance till.how much interest i want to pay including intetrest
